REACH concerning the Registration, Evaluation, Authorisation and Restrietion of Chemicals (EC1907/2006) , has entered into force on I June 2007.

 

First, in accordance with the TITLE I Chapter 2 Article 3 (3)1 and TITLE II Chapter 1 Article 7 (1) 2of REACH, the products manufactured and sold by Chy-tech (H.K.) Industrial Co.,Limited, and its affiliates ("CHY-TECH") are Articles and the substances in the Articles are not intended to be released under normal or reasonably foreseeable conditions of use, therefore,CHY-TECH does not need to submit a pre-registration or a registration to European Chemicals Agency (*ECHA"). 

 

Second, in accordance with theTITLE II Chapter 1 Article 7(2)3and FTILE I Chapter 1 Article 7(3)4 of REACH. CHY-TECH shall disclose and provide recipients with information on Substances of Very High Concern ("SVHC") of the products if those are present above a concentration limit of 0.1% on an article level. 

 

Now, on February 17, 2011, the ECHA announced that it will ban six substances of very high concern (Musk xylene,MDAHBCDDDEHP, BBP. DBP) in three or five vears unless companies seeking to continue their use obtain authorization under REACH regulation. 

 

Currently, Well Shin has already follow the information issued by ECHA and the TITLE IV Article335of REACH to investigate our products, we will notify ECHA from 1 January 2021 and hope to cease using all the SVHC or to reauire authorization for continue use before the sunset date.

 

It is anticipated that substances used in our products will be registered by raw material manufacturers within supply chain, and CHY-TECH also will work with its suppliers to ensure that all SVHC are notified to ECHA, and to comply with this REACH requirement.

Note

1 「Article: means an object which during production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition; 」

2 「Any producer or importer of articles shall submit a registration to the Agency for any substance contained in those articles, if both the following conditions are met:

(a) the substance is present in those articles in quantities totalling over 1 tonne per producer or importer per year;

(b) the substance is intended to be released under normal or reasonably foreseeable conditions of use.」. 

3 Any producer or importer of articles shall notify the Agency, in accordance with paragraph 4 of this Article, if a substance meets the criteria in Article 57 and is identified in accordance. with Article 59(1), if both the following conditions are met:

(a) the substance is present in those articles in quantities totalling over 1 tonne per producer or importer per year;

(b) the substance is present in those articles above a concentration of 0,1 % weight by weight w/w).

4 Paragraph 2 shall not apply where the producer or importer can exclude exposure to humans or the environment during normal or reasonably foreseeable conditions of use including disposal. In such cases, the producer or importer shall supply appropriate instructions to the recipient of the article..

5 (1) Any supplier of an article containing a substance meeting the criteria in Article 57 and dentified in accordance with Article 59(1) in a concentration above 0,1 % weight byweight (w/w) shall provide the recipient of the article with sufficient information, availableto the supplier, to allow safe use of the article including,; as a minimum, the name of that substance. (2) On request by a consumer any supplier of an article containing a substance meeting the criteria in Article 57 and identified in accordance with Article 59(1) in a concentration above 0,1 % weight by weight (w/w) shall provide the consumer with sufficient information, available to the supplier, to allow safe use of the article including, as a minimum, the name of that substance.
